Rise in challenges to wills

“The Times” recently reported on a survey that showed a rise in challenges to wills  — especially by younger people who are resentful when they feel short-changed by bequests.

The number of challenges by relatives has leapt by 20 per cent in the past decade, with the younger generation believing that passing on inheritance is a moral obligation.

Multiple marriages and children from different relationships also provide complications when it comes to deciding who gets what.

Also bequests to charities at the expense of family members can cause resentment. In a recent case a daughter was awarded £160,000 of her mother’s estate in court, despite the will having left it all to three animal charities.

Yet despite the rise in challenges to wills, the majority of those surveyed said that inheritance wishes should be exempt from legal challenge.
